North Carolina Consumer Privacy Act (NCCPA): Potential Impact on Data Collection Practices

If you are a North Carolina resident, the proposed North Carolina Consumer Privacy Act (NCCPA) could significantly impact how data is collected within Emoti Labs platforms. The North Carolina Consumer Privacy Act (NCCPA) on data collection practices proposes to grant new privacy rights to North Carolina residents. The NCCPA remains under review by the Senate Committee on Rules and Operations. The committee's decision on the bill and its potential passage into law are unknown at this time.

The NCCPA, if enacted, may raise concerns regarding the collection of data by third parties on Emoti Labs platforms. This data collection could be impacted in two key areas:

Interest-Based Advertising: The NCCPA might restrict the ability of third-party advertisers to collect data on Emoti Labs platforms for the purpose of targeting users with personalized advertisements.

Social Media Tools: The NCCPA may also regulate how social media tools embedded within Emoti Labs platforms handle user data.

If you are a California resident, the California Consumer Privacy Act (“CCPA”) may permit you or your authorized agent to opt out of the “sale” of your personal information to third parties. Based on the CCPA’s broad definition of the term “sale,” certain data collection on our sites and applications by third parties for purposes of interest-based advertising and social media tools may be a “sale” under the CCPA.

To opt out, these devices typically require you to select options like “limit ad tracking” or to disable options such as “interest-based advertising,” “interactive TV,” or “smart interactivity.” These settings vary by device type.

Practical Tip: These opt out tools are limited to the device and web browser you use to opt out because they work off of your device ID or browser ID. If you use another device or browser, you will need to opt out on each device and browser. If you block or clear cookies from your browser, it may remove the opt out setting, requiring you to opt out again.
